Magisters has set up Distressed Assets, Restructuring, and Bankruptcy multi-practice group to help clients minimize risks and manage their business during economic downturn. The group draws on the Firm's experience in bankruptcy and insolvency, corporate and finance restructurings, taxation and dispute resolution to deliver comprehensive advice and practical solutions.

The Group focuses on debt and corporate restructuring, insolvency and bankruptcy proceedings and transactions with distressed assets.

Broad experience of the Group members allows us to identify the most legally and commercially sound options to address our clients’ needs in deals that require tailored solutions and attention to detail.

We advise international corporations, major CIS-based private companies, groups of creditors on matters of finance and corporate restructuring, represent clients in bankruptcy and insolvency proceedings in local courts. We are closely familiar with the technical side of the proceedings and take a practical approach to achieving the goals of our clients.

Our strong relationships with major global law firms supported by our unique expertise in local restructurings and insolvency proceedings allow us to service complex international finance and corporate restructurings.

  • developing debt and security restructuring schemes with a special emphasis on feasibility and enforceability of such structures;
  • advising on efficiency of debt recovery schemes;
  • representing clients in insolvency, bankruptcy and related proceedings before local courts;
  • advising on setting up distressed assets pools and investment into such pools of distressed assets;
  • comprehensive pre-restructuring legal due diligence of businesses;
  • advising on structures for corporate reorganization of industrial and finance groups (both national and cross-border);
  • assistance in foreclosing against security over assets located in the CIS, and enforcing guaranties and suretyships issued by the CIS-based entities;
  • recognition and enforcement of arbitral awards in Ukraine, Russian, Belarus and Kazakhstan.
